Terms of Service

The agreement between you and us. Plain English, no filler. The parts that limit what you can expect from us are marked so you cannot miss them.

01Who we are, and what this covers

qubesquad.com is operated by DEK COMMERCE LLC (a Wyoming limited liability company). Our mailing address is 30 N Gould St Ste N, Sheridan, WY, 82801, United States.

These Terms are the agreement between you and us. They apply every time you use our website, your dashboard, or a game server you rent from us. If you do not agree with them, do not use the service.

Three other pages are part of this agreement, and you should read them too: the Acceptable Use Policy (what you may not run on our network), the Refund and Cancellation Policy (how cancelling and refunds work), and the Privacy Policy (what we collect and who we share it with).

02What the service is

We rent you a game server. You pick a game, we set it up on our hardware, and you manage it from your dashboard in the browser: start and stop it, use the console, edit files, install mods and plugins, and make backups.

Your server gets its own address in the form yourname.qubesquad.net, so you can share one address with your friends even if we later move the server to different hardware.

You can switch the game on your server as often as you like, at no extra cost. Switching wipes the running setup for the new game, so take a backup first if you want to come back to the old world.

03The service is provided as is

We provide the service as is and as available. We do not promise it will be uninterrupted, error free, or that it will meet your particular needs.

To the fullest extent the law allows, we disclaim all warranties that are not written down here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow certain disclaimers, so parts of this may not apply to you.

Games, mods, plugins and modpacks are made by other people. We do not warrant that any of them will work, keep working, or be free of bugs.

04Your account

You need an account to buy a server. You must give us a working email address and keep it current, because that is how we tell you about payment problems, suspensions and deletions.

You must be at least 13 years old to hold an account. If you are under 18, you may only use the service with the involvement of a parent or guardian, and only they may pay for it. If we learn that an account holder is under 13, we close the account and delete their personal information (see the Privacy Policy).

You are responsible for what happens on your servers

Everything that happens on a server you rent is your responsibility. That includes what you install, what your players do, what any friends or staff you give access to do, and anything done by someone using your password.

  • Keep your password to yourself, and use a strong one. Tell us straight away if you think someone else has got into your account.
  • If you give other people access to your server, you are still the person responsible for it.
  • Do not use the service in a way that breaks the Acceptable Use Policy or the law.
  • You are responsible for moderating your own community, including anything your players say or upload.

We sell one plan, at one price, for every game we host: $9.99 per month.

Every game in our catalog. Switch as often as you like.

One plan covers one server. If you want a second server, you buy a second plan.

Some games need more memory or disk than the base plan gives, so those games can only be bought with the Performance Boost added. We tell you that at checkout, before you pay.

06The Performance Boost

The Performance Boost is an optional add-on for $4.99 per month on top of the plan, so $14.98 per month in total. It makes your server bigger:

You can add or remove the boost at any time from your billing page. Adding it mid-month is charged pro rata by our payment processor, and removing it credits the unused part against your next invoice.

There are two cases where we cannot remove the boost for you: if your game cannot run without it, and if your server is currently using more disk than the smaller size allows. In the second case, free up space first.

07Billing, automatic renewal and price changes

This is a subscription. It renews automatically every month and keeps charging your card until you cancel it. You can cancel at any time from your dashboard, in a couple of clicks.

We take card payments through Stripe. Your card details go straight to Stripe and are never stored on our systems. Prices are in US dollars. If sales tax applies to your purchase it is shown at checkout before you pay.

If we change the price

We can change our prices. If a change affects a plan you already have, we will email you at least 30 days before it takes effect, and tell you the new price and the date. If you do not want to pay the new price, cancel before that date and you will never be charged it.

We can also change what the plan includes. If a change makes the plan meaningfully worse for you, we will tell you the same way, and the same 30 days apply.

08Cancelling

Cancel from your dashboard, on the Billing page, at any time. Cancelling stops the renewal. It does not end the month you have already paid for: your server keeps running until the end of that period.

When the paid period ends after you cancel, your server and every backup on it are deleted straight away. There is no extra grace period, because you chose the end date and had the whole month to take your data out.

We do not refund the unused part of a month when you cancel. The full details are in the Refund and Cancellation Policy.

09Suspension: what causes it, and what happens to your data

Suspension stops your server and locks the controls in your dashboard. It does not delete anything. Your world, your files and your backups all stay exactly where they are.

What causes a suspension

  • A failed renewal payment. We suspend as soon as a renewal invoice fails, not after several retries.
  • A chargeback or payment dispute on one of your invoices. We suspend the affected server while the dispute is open.
  • Abuse. If a server is attacking other people, mining cryptocurrency, or using so much of a machine that other customers suffer, we suspend it, and we can do that immediately and without warning. See the Acceptable Use Policy.
  • A legal requirement, or a credible report of illegal content.

How to get a suspended server back

  • Payment problem: pay the outstanding invoice, or update your card, from the Billing page. Your server is unsuspended and your files are untouched.
  • Abuse: contact support and tell us what happened and what you have changed. We decide case by case.
  • Chargeback: contact us. See the Refund and Cancellation Policy, section on chargebacks.

10Termination and deletion of your data

Termination is permanent. It deletes your server, its world, its files and all of its backups. We cannot get any of it back afterwards, no matter how soon you ask.

When it happens

If a payment fails
We suspend the server at once (files preserved) and email you. If the invoice is still unpaid 5 days later, the server and its backups are permanently deleted. Paying inside those 5 days gets everything back.
If you cancel
The server runs until the end of the period you paid for, then it and its backups are permanently deleted at that point, with no further grace period.
For serious abuse
We may terminate immediately in serious cases, for example illegal content or an attack launched from your server. No refund is given.

The 5-day grace period is our current policy, and the email we send when we suspend a server tells you the exact date the data will be deleted. Take a backup out before that date if you want to keep it.

You can also close your account yourself from the dashboard, once you have cancelled and removed all your servers. Closing your account erases your personal details permanently. We keep invoices and refund records, because we have to keep financial records. See the Privacy Policy.

11Backups are your responsibility

Read this section even if you skip the rest. We give you a backup feature. We do not promise your backups exist, are complete, or will restore, and we are not responsible for data you lose. If it would upset you to lose it, download a copy and keep it yourself.

Your plan includes 2 backup slots, or 4 with the Performance Boost. You create backups yourself from the Backups tab in your dashboard, and you can download them or restore them from there. When your slots are full, delete an old backup to make a new one.

  • A backup is a snapshot taken at the moment you ask for one. It does not include anything that changed afterwards.
  • Restoring a backup overwrites what is on the server now. That is not reversible.
  • Backups belong to the server. When the server is deleted, for any reason, the backups are deleted with it.
  • Backups are stored on the same machine as your server. They are a convenient way to undo a griefed base or a bad update. They are not a disaster recovery service.
  • Because they live on that machine, a hardware or storage failure can take the server and its backups at the same time. We do not hold a second copy of your world anywhere else.
  • We do not test that every backup restores, and a backup can fail to restore for reasons outside our control, including a mod or game version that has changed underneath it.

Keeping your own copy of your world is your job, not ours. Download a backup whenever your world matters to you. It takes a minute, and it is the only thing that actually protects you.

We are not liable for any loss of your data, however it happens. That includes backups that are missing, incomplete, corrupted or will not restore, data lost to a hardware failure, data lost when a server is suspended or deleted, and data lost because of something you, a player or a mod did. If you have not downloaded a copy, we cannot get it back for you.

12Resource limits: a maximum, not a reservation

A plan sells you an upper limit, not a private machine. The memory, processor and disk numbers are ceilings your server may not exceed, not hardware set aside only for you.

Your server runs in a container on a machine shared with other customers. We size machines so that normal use is comfortable, but performance depends on the game, the mods you run, how many players are on, and what everyone else on the machine is doing at that moment.

  • Memory and disk are hard limits. A server that tries to use more will be stopped by the limit, not given more.
  • The processor limit is a share, and it is a maximum. We do not guarantee you will always get all of it.
  • Network bandwidth for normal gameplay is not metered, but sustained transfer far above what a game server needs is capped, and can be treated as abuse.
  • We do not sell player slots, and we do not cap them. How many players actually run well depends on your game and settings.

13Maintenance, restarts and moving your server

We may restart your server, or move it to different hardware, when we need to for maintenance, security or stability. We try to do planned work at quiet times and to tell you first, but urgent work (a security patch, a failing drive, an attack in progress) happens immediately and without notice.

Moving a server does not change the address your friends use, because your qubesquad.net hostname follows the server.

We may also update the operating system, the container images and the management software your server runs on. Occasionally that means a game version or a mod loader needs updating too.

14Games, mods and other people's content

You are responsible for having the right to use every game, mod, plugin and modpack you install, and for following its licence.

We are not affiliated with, endorsed by or sponsored by any game publisher or developer. Game names and trademarks belong to their owners, and we use them only to say which game a server runs.

  • Some games require you and your players to own a legitimate copy. That is between you and the publisher.
  • Mods, plugins and modpacks have their own licences and terms. Read them. Some forbid commercial use, some forbid redistribution.
  • We provide links and installers to mod repositories as a convenience. We do not check, endorse or support the content in them.
  • If a rights holder tells us content on your server infringes their rights, we may remove it or suspend the server. Send copyright notices to [email protected].

Anything you upload stays yours. You give us permission to store, copy and transmit it only so far as we need to in order to run the service for you.

15Uptime: what we do and do not promise

We do not offer a service level agreement, an uptime percentage, or service credits. Please do not buy this service on the basis that we have promised one.

What we actually do: we run the service around the clock, we monitor it, we publish a status page, and we work to fix outages quickly. Attack filtering is included on every plan.

What is outside our control: your internet connection, the game publisher's own services, a mod or plugin that crashes your server, and anything you or your players change. Time lost to those is not our responsibility.

If we have a long outage that is our fault, tell us. We look at goodwill credits or refunds case by case (see the Refund and Cancellation Policy), but that is a discretion, not an entitlement.

16Our liability is limited

Our total liability to you is capped at the amount you actually paid us in the 12 months before whatever you are complaining about happened.

We are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost goodwill, or the value of a lost world or save file, even if we were told that kind of loss was possible.

Nothing in these Terms excludes liability that the law does not allow us to exclude. Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

You cover us for what happens on your server

If someone brings a claim against us because of what you did with the service, what you put on your server, or what your players did there, you will cover our reasonable costs and any damages, and we will tell you promptly about the claim.

17When we can suspend or close your account

  • We can suspend a server immediately, without notice, if it is actively causing harm (an attack, illegal content, or a load that is degrading other customers). Suspension preserves your files.
  • We can close an account for repeated or serious breaches of these Terms or the Acceptable Use Policy, for fraud or chargeback abuse, or where we are legally required to.
  • We can refuse or cancel an order, and refund it, if we cannot supply it or we believe it is fraudulent.
  • We can stop offering a particular game, or the whole service. If we withdraw the service we will give you reasonable notice and refund any period you have paid for but not received.

18How we change these terms

We can change these Terms. The current version always lives on this page, with the date it took effect at the top.

  • For small changes (clearer wording, a new contact address) we update this page.
  • For changes that materially affect you, we email the address on your account at least 30 days before they take effect.
  • If you do not accept a change, cancel before it takes effect. Continuing to use the service after that date means you accept the new version.
  • Price changes follow the same 30-day notice, described in the billing section above.

19Where we sell

We are a United States company, and we currently sell to customers in the United States. These Terms are written for US law.

You can play from anywhere and pick a server location anywhere we host, but the contract is a US one. If we start selling into other countries, we will add the terms those countries require to this page and tell you before they apply to you.

20Governing law and where disputes are heard

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules.

Any dispute arising out of these Terms or the service will be brought exclusively in the state or federal courts located in Wyoming, and you and we both agree to the jurisdiction of those courts.

If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce something straight away, that does not mean we have given up the right to.
